I. General Terms and Conditions
§ 1 Basic provisions
(1) The following business terms are applicable to all the contracts, which you conclude with us as a supplier (Vila Ceramica GmbH) via the www.vila-ceramica.com and www.vila-ceramica.net websites. Unless otherwise agreed, the inclusion of your own terms and conditions, if any, is contradicted.
(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. An entrepreneur is any natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in exercise of his or its independent professional or commercial activity.
§ 2 Formation of the contract
(1) The subject of the contract is the sale of goods, in particular handmade ceramic products (e.g. tableware, cups, plates, decorative items).
(2) By placing the products in our online store, we submit a binding offer to conclude a contract.
(3) The contract is concluded via the online shopping cart system as follows:
The items intended for purchase are placed in the "shopping cart". After calling up the shopping cart and going through the electronic ordering process, you submit a legally binding offer to conclude a purchase contract by clicking on the final button. You can change your entries at any time before sending the order or cancel the order process.
(4) Depending on the payment method selected (e.g. PayPal, Stripe, Klarna), you will be redirected to the website of the respective payment provider. There you make the payment and are then redirected back to our store, where the order details are displayed again.
(5) The contract is concluded with the confirmation of the order by e-mail or at the latest with the delivery of the goods.
(6) Order processing is automated by e-mail. Please make sure that your e-mail address is correct and that receipt is technically ensured (e.g. no SPAM filter).
§ 3 Special agreements on payment methods
(1) The payment methods offered (PayPal, Klarna, credit card via Stripe, prepayment, cash on collection if applicable) are displayed during the ordering process. In addition, the terms and conditions of the respective payment provider apply (e.g. PayPal-AGB, Klarna-AGB, etc.).
(2) If you select "Pick up on site", the ordered goods will not be delivered but handed over in our store in Münster (Rothenburg 9, 48143 Münster). Payment can be made in cash on collection or in advance via online payment.
§ 4 Right of retention, retention of title
(1) You may only exercise a right of retention insofar as it concerns claims arising from the same contractual relationship.
(2) The goods shall remain our property until full payment has been made.
§ 5 Warranty
(1) The statutory liability for defects shall apply.
(2) Consumers are requested to check the goods for completeness and obvious defects upon receipt and to report any damage immediately. This serves the purpose of quick processing, but does not affect your statutory warranty claims.
(3) Deviations in color, shape or glaze structure may occur in handmade ceramics and do not constitute a defect.
§ 6 Choice of law, place of performance, place of jurisdiction
(1) German law shall apply. The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.
(2) The place of performance for all services is Berlin. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction shall be Berlin.
(3) The statutory place of jurisdiction remains unaffected for consumers.

(5) Payments are due immediately, unless otherwise agreed.
6. delivery and collection conditions
(1) Delivery will be made to the address you provide.
(2) Alternatively, you can collect the goods free of charge from the store.
(3) The delivery time and shipping costs can be found in the respective offer.
(4) The risk of loss or damage to the goods is only transferred to consumers upon delivery.
